Terms & conditions

INTRODUCTION - At Vero Fitness, we have adopted policies, procedures, rules and regulations ("policies") designed to provide for the safe, enjoyable and healthy use of our premises and events by you - our members and guests. These policies apply to your conduct on Vero Fitness premises which include its indoor and outdoor areas, including its parking lots and sidewalks ("premises"), or any use of Vero Fitness online, mobile or interactive offerings, or websites. They also apply to your conduct during its programs, training, events or other Vero Fitness-sponsored activities off the premises ("events"). These policies supplement those posted or otherwise provided in our centers, on our web or mobile sites, or at our events. We may adopt policies applicable to a single center. In some instances, the law may establish different requirements applicable to certain centers and may not be called out here. To the extent of a conflict with other policies, the more restrictive policy applies. If you violate any of these policies, your membership or access may be suspended or terminated. Our decision on all questions regarding construction or interpretation of these policies is final.

DUES AND PAYMENTS - We collect monthly membership dues and certain other payments (such as recurring payments for services) within the first five days of each month or at an additional date designated by you for certain products or services by electronic fund transfer from the designed bank account or credit or debit card on file for your membership ("EFT Account"). If we are unable to successfully draft payments from your EFT Account when due, we will continue to attempt collection thereafter. I understand that Vero Fitness may use services made available by card issuers which automatically update my card information and prevent disruptions due to account changes, such as an expired card or reissued card. We are not responsible for overdraft fees. We do not issue regular monthly invoices. To establish your membership, you must provide an EFT Account. In special circumstances, however, you may avoid a forthcoming monthly dues electronic funds transfer by providing an alternate method of payment to the Membership Services Desk at least three business days prior to the last day of the month. In the event of a change in any amount charged, Vero Fitness may provide any notice required by law by email to the address(es) associated with the membership.

FEES - Subject to the provisions below and any variation required or permitted by state law, we may charge certain fees to members as set forth in our Fee Schedule, which may be periodically updated in our sole discretion. Returned or Declined Payments acquire a $10 fee to be paid with the balance on the account. Holding or opening the door for another Vero Member or non-member during unstaffed hours will result in a $100 fee and potential suspension or termination of your membership with no exceptions and no refunds. An Administration Fee of up to $39.99 applies to all new memberships unless otherwise allowed by Vero Fitness.

 

MEMBERSHIP CANCELLATION - All cancellations are subject to a 30-day written notice. The required cancellation form is available at the front desk during staffed hours. Dues will continue to be charged during this notice period. No refunds will be issued for partial months or unused time.

24 HOUR SERVICES - Vero Fitness, while open 24 hours a day, has staffed and unstaffed hours. During unstaffed hours the back door and garage must remain closed and should not be opened for any reason with the exception of life-threatening situations. Access to the office, treatment rooms, and staff-only areas are not permitted during staffed and unstaffed hours. If you were grandfathered into the original membership price during the months per terms of arrangement with Vero Fitness, and you cancel and decide to return, the terms of that contract and agreement will no longer apply and you must abide by the new membership rates. If you have a balance of any kind on your account, you will not have access 24 Hours via the automated door. By signing these terms and conditions, you acknowledge and accept that during unstaffed hours there will be no party from Vero present to help in any emergency situation, including but not limited to injury and illness. You also acknowledge and accept that the violation of these terms may result in fees and/or suspension or termination of your membership with no refunds and no exceptions.

CAMERAS, PHOTOGRAPHY, & MEDIA USE - For the safety and security of all members, guests, and staff, Vero Fitness utilizes 24-hour video surveillance throughout the facility, including in workout areas, hallways, entry/exit points, and other public/common spaces. By entering the premises, you understand and consent to being recorded by these security cameras at any time.

In addition, Vero Fitness staff may occasionally capture photos or videos for marketing, social media, or other promotional uses. By signing this waiver, you grant Vero Fitness the irrevocable right to use, reproduce, and publish your image, likeness, and/or voice in such materials, without any form of compensation. If you do not wish to be included in promotional media, you must notify Vero Fitness staff in writing prior to participation or entry.

 

Personal photography or video recording by members or guests is permitted only in designated public areas and only with the consent of all individuals who are visible or identifiable. The use of cameras or recording devices is strictly prohibited in all private spaces including, but not limited to, changing rooms, restrooms, saunas, or treatment rooms. Any violation of this policy may result in immediate suspension or termination of your membership or facility access.

CLASS ETIQUETTE - We request that you arrive for class a few minutes early to prepare your space or equipment (e.g., yoga mat, props, etc.) and, as applicable, sign in. The warm-up at the outset of the class is an important part of the work out. If you arrive late, please enter the class quietly and appropriately. Because classes are designed as group activities, you should follow the instructor`s routines or instructions consistent with your personal abilities and limits. You must wait for a class to conclude before entering the studio to prepare for the next scheduled class. Please wear attire and, except for yoga, shoes appropriate for the class. You must have a sweat towel for mat work, and may keep closable, unbreakable water bottles at the perimeter of the studio. No other personal effects are permitted in the studio. Your cell phones must be turned off or in silent mode. After class, please wipe down and return all equipment to its proper place. Only Vero Fitness Team Members may operate the stereo and lighting equipment.

SPECIAL YOGA ETIQUETTE - To avoid disruption, you should not enter class during opening meditation or leave during the closing resting pose. If you must leave class, please inform the instructor at the outset and do so before the final pose. You should wear comfortable layered, stretchable clothes, and no shoes, perfumes, or heavy jewelry. During yoga, you are allowed to limit the amount of clothing worn; men may remove shirts and women may choose to practice in a supportive garment. Shirts and shoes must be worn when exiting the yoga area to go to other areas of the club.

PERSONAL TRAINING SERVICES - Our personal training services include instruction, coaching, advice, lessons or demonstration concerning physical exercise, physical fitness, exercise strategies, nutrition, wellness, fitness products, fitness equipment and other fitness-related activities by personal trainers, nutrition coaches, teaching pros or other instructors ("personal training"). Personal training services are available to members, typically for a fee per session, upon completion of a Fitness Program Agreement. No Personal Training may be conducted by members or guests of the gym. You may not solicit or conduct on the premises any personal training as defined above, with or without compensation. Vero Fitness retains sole discretion to determine whether a member or guest is engaged in personal training.

APPOINTMENT CANCELLATION POLICY - Please understand that appointment times are limited. If you must cancel your appointment, we respectfully request 24 hours notice. Missed appointments or appointments canceled without 24 hour notice will incur a fee equal to the charge of your session.

MEDICAL CONSIDERATIONS - All participation in fitness and wellness activities should be performed with care and consideration that no medical condition would prevent participation.Vero Fitness does not provide medical advice or diagnosis. If you have or develop a medical condition, we recommend consulting with a physician before participating further. Cease activity immediately if you experience light-headedness, dizziness, pain, or discomfort.

SAUNA AND RED LIGHT THERAPY GUIDELINES

  • Sessions should not exceed 30 minutes

  • Maximum temperature for sauna use is 150°F

  • Proper hydration is encouraged before and after sessions

  • No nudity is allowed. One adult per sauna session.

  • Water bottles, electronics, and items with cosmetic glue (eyelashes, extensions, etc) should not be brought into these spaces

  • Use is not allowed for individuals under 1 unless accompanied by a supervising adult

  • Members are responsible for monitoring their own safety and use

INBODY BODY COMPOSITION SCANNER - The scanner uses bioelectrical impedance and should not be used by individuals with pacemakers or other implanted electronic medical devices. Additionally, anyone with a known heart condition should consult a physician before using the scanner. Use of the scanner by individuals with such conditions is strictly prohibited unless cleared by a medical provider.

GENERAL POLICIES PROPER CONDUCT - We strive to uphold a safe, fun, family-oriented environment. As such, we expect proper, respectful conduct on the premises at all times. We do not permit disrespectful conduct toward our members, guests, employees ("Team Members"), vendors or property, including but not limited to vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, fraudulent, or other inappropriate conduct or communications.

GENERAL HYGIENE - We expect you to uphold general personal hygiene and refrain from excessive use of scented oils, lotions, colognes, perfumes or other fragrances out of respect for other members and any fragrance or chemical sensitivities.

​

WEAPONS - You may not bring or use weapons of any kind on the premises for any reason.

​

PROPER ATTIRE - You must always wear proper attire, including shirts and closed toe shoes, unless noted in a specific area.

​

MEMBERSHIP CARDS AND CHECK IN - As a member, you may not enter the center without your membership card, whether electronic or physical, which you must present to the front desk to be swiped upon entry. If you lose your membership card, you may have to pay a fee to replace it. Please return your membership card on your last day of access.

​

PERSONAL BELONGINGS - You must store all workout bags, coats and personal belongings in a locker. Be sure that your locker is secured before you leave it. You may use our lockers only while you are on the premises; you may not leave any personal belongings in a locker overnight. Do not bring or store any valuables on the premises, including watches, jewelry or large amounts of cash. Do not leave valuables in plain view in your vehicle. Be sure your vehicle is locked. We are not liable or responsible for any lost, stolen or damaged personal property, whether from lockers, vehicles or other locations on the premises. Please inquire in person at the Member Services desk for lost articles that may have been found. Phone inquiries regarding lost items are not allowed.

INJURIES - If you are injured while on the premises, please seek immediate assistance from a Vero Fitness Member. A Team Member can provide or arrange for appropriate medical assistance and complete an incident report.

​

PHYSICAL EXAMINATIONS - We strongly encourage that you have a complete physical examination prior to beginning any new exercise or nutrition program.

​

SOLICITATION - Unless expressly authorized by Vero Fitness owner, you may not solicit-whether in person or in writing-any members, guests or Team Members on the premises or during off-premises events, including but not limited to solicitations for political or religious purposes, media interviews, business opportunities, or competitive products or services.

​

YOU ACCEPT THIS RISK AND ACCEPT FULL RESPONSIBILITY FOR YOUR EXERCISE AND TRAINING - You will in no way hold Vero Fitness Personal Training or your trainer liable for any injuries or illness sustained. You also agree that you have no undisclosed injury or illness that may affect your ability to undertake rigorous exercise and to the best of your knowledge you are ready and able to undertake this exercise program.

 

WAIVER & RELEASE

In consideration of participating in health or fitness club activities, and for other good and valuable consideration, I hereby agree to release and discharge the liability arising from negligence vero fitness and its owners, directors officers, employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as "releasees"), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate and also agree as follows:

  1. I acknowledge that health or fitness club activities involve known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death and property damage. Risks include, but are not limited to, musculoskeletal injuries, broken bones, and/ or overuse injuries, injuries caused by equipment that breaks for otherwise fails; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.

  2. I expressly accept and assume all risks inherent in this activity or that might have been caused by the negligence of the releases. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.

  3. I hereby voluntarily release, forever discharge and agree to indemnify and hold harmless releases from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intention conduct. Should releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

  4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further state that I have no medical or physical conditions which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition.

  5. In the event that I file a lawsuit, I agree to do so in the state of where the facility is located, and I further agree that the substantive law of that state shall apply.

  6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By signing this document, I agree that if I am hurt or my property is damaged during my participation in this activity then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence. I have had enough time to read this entire document and should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or that the cost to engage in this activity would significantly greater if I were to choose not to sign this release, and agree that the opportunity to participate at the stated cost in return for the execution of this release is a reasonable bargain.
